1. Acceptance of terms

By accessing or using AusCareGuide (auscareguide.com.au), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service. By creating an account or subscribing to a paid plan, you enter into a binding agreement with Neoterik, the operator of AusCareGuide.

2. Service description

AusCareGuide is an online directory of care service providers in Australia, including NDIS providers, aged care services, mental health practitioners, and registered migration agents.

  • Provider data is sourced from publicly available Australian government registers and from provider self-submissions.
  • AusCareGuide does not provide medical, health, disability, aged care, legal, or migration advice.
  • AusCareGuide does not endorse, vet, recommend, or guarantee any listed provider.
  • AusCareGuide is not affiliated with the NDIS Quality and Safeguards Commission, the NDIA, OMARA, or any government body.

3. User accounts

To claim a listing, submit a new listing, or subscribe to a paid plan, you must create an account by verifying your email address. You are responsible for maintaining the security of your account and for all activity that occurs under it.

4. Provider listings

Government-sourced listings

Listings sourced from government registers are published under applicable open government licences (including Creative Commons Attribution 4.0 International Licence where applicable). This data is provided "as is" and may be updated or removed as source data changes.

Claimed and self-submitted listings

Providers who claim or submit a listing represent and warrant that:

  • They are authorised to act on behalf of the organisation listed
  • All information they provide is accurate, current, and not misleading
  • They will update their listing promptly when any material information changes
  • They will comply with all applicable Australian laws and regulations governing the advertising and provision of their services, including health practitioner advertising restrictions where applicable

Our right to modify or remove listings

AusCareGuide reserves the right to modify, suspend, or remove any listing at any time, with or without notice, for any reason including but not limited to: inaccurate information, deregistration from a government register, provider misconduct, complaints from users, or breach of these Terms.

5. Prohibited conduct

You agree not to:

  • Scrape, crawl, or systematically download data from the site (except search engine indexing)
  • Submit false, misleading, or fraudulent listings or enquiries
  • Impersonate another person or organisation when claiming a listing
  • Use the service to send spam, unsolicited messages, or harassment
  • Attempt to gain unauthorised access to any part of the service
  • Use the service for any unlawful purpose

6. Subscription plans and payments

Plans and pricing

AusCareGuide offers optional paid subscription plans for providers:

  • Enhanced: $49/month (GST inclusive)
  • Premium: $149/month (GST inclusive)

Claiming a listing and maintaining a basic profile is free. Paid plans provide additional features such as priority placement, verified badges, and lead management tools.

Auto-renewal

Subscriptions automatically renew at the end of each monthly billing period at the then-current subscription rate unless you cancel before the renewal date. By subscribing, you authorise us to charge your payment method on a recurring basis.

Cancellation

You may cancel your subscription at any time through your provider dashboard or by contacting [email protected]. Cancellation takes effect at the end of your current billing period - you will retain access to paid features until that date. Cancellation is as simple as signing up.

Refunds

Please see our Refund & Cancellation Policy for full details. We do not offer refunds for change of mind. Your rights under the Australian Consumer Law are not affected.

Payment processing

All payments are processed securely by Stripe. AusCareGuide does not store your credit card details. Stripe's own terms and privacy policy apply to payment processing.

7. Intellectual property

  • Government data is used under applicable open data licences and attributed accordingly.
  • The AusCareGuide name, logo, website design, and original content are the intellectual property of Neoterik.
  • Providers who submit content (descriptions, photos) grant AusCareGuide a non-exclusive, royalty-free licence to display that content on the site for the purpose of operating the directory.

8. Limitation of liability

To the maximum extent permitted by law, AusCareGuide, its operator (Neoterik), and its affiliates shall not be liable for:

  • Any loss or damage arising from reliance on information in this directory
  • The acts, omissions, conduct, or quality of service of any listed provider
  • Any decision made based on information obtained through this site
  • Any interruption, delay, or failure of the service
  • Any indirect, incidental, special, or consequential damages

This limitation does not exclude or limit liability that cannot be excluded or limited under Australian law, including liability under the Australian Consumer Law consumer guarantees.

9. Indemnification

You agree to indemnify and hold harmless AusCareGuide and Neoterik from any claims, losses, or damages arising from your breach of these Terms, your use of the service, or any content you submit to the platform.

10. Termination

We may suspend or terminate your account at any time for breach of these Terms, with or without notice. You may close your account at any time by contacting [email protected]. Upon termination, your claimed listings will revert to unclaimed status and your personal information will be handled in accordance with our Privacy Policy.

11. Changes to terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. If you have an active subscription, we will notify you of material changes by email at least 14 days before they take effect. Continued use of AusCareGuide after changes constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of AusCareGuide are subject to the exclusive jurisdiction of the courts of Queensland, Australia.

Before commencing legal proceedings, you agree to first attempt to resolve any dispute by contacting us at [email protected]. You may also lodge complaints with the Australian Competition and Consumer Commission (ACCC) or your state or territory fair trading body.
